محامى المخلوع يهدد بالتنحى عن الحكم فى قضية مبارك نهائيا اذا غاب المشير طنطاوى مرة اخرى عن الشهادة
اكد المحامى أشرف عجلان عضو هيئة الدفاع عن أسر الشهداء بقضية محاكمة الرئيس المخلوع حسنى مبارك وابناءه جمال وعلاء مبارك ووزير داخليته السابق حبيب العادلى وستة من كبار مساعديه بتهمة قتل المتظاهرين اثناء اندلاع الثورة المصرية بأنه لابد ان يحضر المشير حسين طنطاوى رئيس المجلس الاعلى للقوات المسلحة للمثول امام هيئة المحكمة للادلاء بشهاداته يوم 24 سبتمبر القادم مؤكدا انه فى حالة تغيب المشير عن الحضور سنصبح امام ثلاثة احتمالات مختلفة اؤلهم أن يأمر المستشار أحمد رفعت رئيس المحكمة بضبطه وإحضاره أو أن يتم الحكم عليه بغرامة تصل إلى الحبس أو يتخذ القاضى موقفًا آخر مثل التنحيى عن نظر القضية والحكم فيها واكد عجلان ان ما يدار الان فى المحكمة يأخذ القضية برمتها فى اتجاه تجهيل الفاعل الاصلى والبعد عن فكرة القتل العمد والمقصود للمتظاهرين وقد طالب بضرورة ضم القضايا المتهم بها العديد من ضباط الشرطة بقتل المتظاهرين حيث انه من غير القانونى فصل القضايا هكذا عم بعضها البعض فلابد من ان تكون جميعها فى قضية واحدة كما نصت المادة 41 من قانون العقوبات والتي تنص على أنه من اشترك في جريمة فعليه عقوبتها
